NBA criticizes Benue Assembly’s decision to remove Chief Judge.

The Nigerian Bar Association (NBA) has strongly criticized the Benue State House of Assembly’s resolution directing Governor Hyacinth Alia to remove Chief Judge Justice Maurice Ikpambwese.

In a statement signed by its President, Afam Osigwe (SAN), and General Secretary, Mobolaji Ojibara, the NBA described the resolution as unconstitutional and a violation of due process.

The association emphasized that only the National Judicial Council (NJC) has the authority to recommend the removal of a Chief Judge. It warned that the Assembly’s actions threaten judicial independence and the rule of law.

Citing the 1999 Constitution, the NBA stressed that the NJC must first investigate any allegations against a Chief Judge before recommending removal. It declared that the absence of an NJC inquiry made the Assembly’s decision invalid.

The NBA urged the judiciary to resist external pressure and directed lawyers in Benue to boycott any judge who assumes the role of Acting Chief Judge under the disputed resolution. It also called on law enforcement to ensure Justice Ikpambwese is not hindered from performing his duties.

“The rule of law must be upheld. The Assembly must reverse this unconstitutional decision,” the statement concluded.
